Acceptance of Terms

By accessing our website at motionperformancestudio.com or using any of our training services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this site or our services. These terms apply to all visitors, members, and users of our website and facilities.

Services Offered

Motion Performance Studio provides small-group strength and conditioning classes (capped at 12 participants) and personal training sessions at our facility located at 828 Hermosa Ave, Hermosa Beach, CA 90254. All classes are programmed by our coaching staff and designed around the principles of progressive overload and individualized programming. The specific structure, schedule, and availability of classes may change at any time.

Membership & Booking

Class bookings are managed through our third-party booking platform, Arketa. By booking a class, you agree to any additional terms presented by Arketa at the time of booking. Cancellations must be made within the timeframe specified in your membership agreement or as communicated by studio staff. Late cancellations or no-shows may result in a forfeiture of the class credit, depending on your membership type. Motion Performance Studio reserves the right to cancel or reschedule classes at its discretion. In the event of a studio-initiated cancellation, affected bookings will be credited or rescheduled.

Health & Safety

You are solely responsible for disclosing any pre-existing health conditions, injuries, or physical limitations to your coach before participating in any training session. This disclosure is essential to ensure your safety and to allow our coaches to provide appropriate modifications. We strongly recommend consulting with a licensed physician or healthcare provider before beginning any new exercise program, particularly if you have a known medical condition, are pregnant, or have been inactive for an extended period. By participating in training at Motion Performance Studio, you represent that you are physically capable of engaging in the activities involved and that you have taken appropriate steps to assess your readiness.

Assumption of Risk

Physical exercise and strength training involve inherent risks, including but not limited to muscular soreness, strains, sprains, and other injuries. By participating in classes or training at Motion Performance Studio, you voluntarily assume all risks associated with physical activity. While our coaches are trained to minimize risk through proper programming, supervision, and instruction, we cannot guarantee that injuries will not occur. You acknowledge that you participate at your own risk and that Motion Performance Studio, its owners, coaches, and staff are not liable for any injury, illness, or loss sustained during participation in our services.

Code of Conduct

Motion Performance Studio is committed to maintaining a welcoming, respectful, and inclusive environment for all members and staff. All participants are expected to: — Treat coaches, staff, and fellow members with respect — Follow all safety guidelines and coaching instructions — Maintain personal hygiene appropriate for a shared training space — Respect studio equipment and report any damage immediately — Refrain from behavior that is disruptive, threatening, or harassing Motion Performance Studio reserves the right to suspend or terminate the membership of any individual who violates this code of conduct, without refund.

Payment & Refunds

All fees, membership rates, and payment schedules are outlined in your individual membership agreement. Payments are processed securely through our booking platform, Arketa. Refund requests are handled on a case-by-case basis in accordance with your membership agreement. For billing questions, disputes, or refund requests, please contact us at hello@motionperformancestudio.com. Motion Performance Studio reserves the right to modify pricing with reasonable advance notice to current members.

All content on this website — including but not limited to text, graphics, logos, images, and programming materials — is the property of Motion Performance Studio and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use any content from this site without our express written permission.

Limitation of Liability

To the fullest extent permitted by applicable law, Motion Performance Studio and its owners, employees, coaches, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, our website or services — including but not limited to physical injury, loss of data, or loss of revenue. Our total liability to you for any claim arising from or related to these terms or our services shall not exceed the amount you paid us in the 30 days preceding the claim.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts located in Los Angeles County, California, and you consent to the personal jurisdiction of such courts.

We reserve the right to modify these Terms of Service at any time. When we do, we will update the "Last Updated" date at the top of this page. Your continued use of our website or services after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically.
